Acceptance of Terms

This document is an electronic record generated by a computer system in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Dingit Technologies ("Dingit", "we", "us", or "our"), governing your access to and use of our mobile applications, software, tools, and the website located at https://getdingit.com/.

By creating an account, browsing our website, or using any Dingit services, you confirm that you have read, understood, and agreed to be bound by these Terms and our companion Privacy Policy and Refund & Cancellation Policy. If you do not agree to these Terms, please do not use the platform.

User Eligibility

Use of Dingit is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872, including un-discharged insolvents, are not eligible to use the platform.

If you are a minor (under 18 years of age), you may browse or use our platform only under the direct supervision and consent of a parent or legal guardian who agrees to be bound by these Terms.

Description of Services

Dingit is a social-logistics platform designed around four core modules:

• Ding Eats: An on-demand local ordering and fulfillment layer connecting users with local restaurants, cloud kitchens, cafes, and everyday lifestyle vendors for fast local delivery.
• Together: A curated date-planning and gifting environment facilitating shared itineraries, couple/friend surprise gifts, and celebration bookings.
• Ding Chat: An encrypted, zero-knowledge private messaging conduit equipped with anti-screenshot safeguards and auto-destruct timers.
• Ding AI: An embedded assistant offering contextual suggestions. Ding AI will never initiate a financial transaction or place an order without an explicit tap-to-confirm gesture from the user.

Account Registration & Security

To access order placement, gifting, or messaging features, you must register using a valid Indian mobile number and verify ownership via SMS One-Time Password (OTP).

• You are solely responsible for maintaining the confidentiality of your device, credentials, and OTP tokens.
• You agree to provide true, accurate, current, and complete information regarding your identity and delivery destinations.
• You must immediately notify Dingit if you suspect any unauthorized access to your account. Dingit cannot and will not be liable for any loss arising from your failure to safeguard your account.

Pricing & Payment Processing

Currency & Charges: All prices displayed on Dingit are quoted in Indian Rupees (INR ₹). Prior to confirming your order, an itemized checkout summary will clearly detail:

• Item price set by merchant partner;
• Applicable government taxes (GST);
• Delivery fee calculated based on transit distance and fulfillment logistics;
• Any platform or packaging charges where applicable.

Accepted Payment Methods: Supported payment instruments via Cashfree include Unified Payments Interface (UPI via Google Pay, PhonePe, Paytm, BHIM, etc.), Credit Cards (Visa, Mastercard, RuPay), Debit Cards, Net Banking across all major Indian banks, and approved prepaid wallets.

Order Placement & Delivery Logistics

Contract of Sale: For Ding Eats and Together orders, Dingit acts as a technology platform facilitating transactions between users and independent merchant partners. When an order is accepted, a bipartite contract of sale is formed between the user and the vendor.

Delivery Timelines:

• Ding Eats (Food & Essentials): Standard estimated delivery ranges between 30 to 60 minutes depending on kitchen preparation, traffic, and distance.
• Together (Gifts & Curated Experiences): Delivered on your scheduled date slot or within 24 to 48 hours for customized gift hampers.

Deliveries are tracked in real-time in the Dingit mobile app. In the event an address is incorrect or the recipient is unavailable after reasonable delivery attempts, the order may be cancelled without a refund to cover perishable food costs and rider transit expenses.

Cancellation & Refund Policy

Our detailed terms for order cancellation and refunds are set forth in our dedicated Refund & Cancellation Policy, which is incorporated into these Terms by reference.

User Conduct & Prohibitions

You agree not to use the Dingit website or app to:

• Transmit any unlawful, defamatory, abusive, obscene, or fraudulent material;
• Harass, stalk, abuse, or demean any user, delivery executive, merchant, or customer representative;
• Attempt to decompile, reverse engineer, intercept, or tamper with Ding Chat cryptographic layers or platform APIs;
• Place fraudulent orders or abuse promotional coupon codes and referral credits;
• Engage in unauthorized screen scraping or automated data extraction.

Violation of these conduct provisions may result in immediate suspension or permanent termination of your account without notice.

Intellectual Property

All trademarks, logos, brand assets, user interface layouts, software code, vector marks (including the Dingit bell-heart icon), and audio brand elements ("ding" sounds) are the exclusive intellectual property of Dingit Technologies. You are granted a limited, personal, non-transferable, revocable license to use the platform solely for its intended purpose.

Limitation of Liability & Disclaimers

Dingit provides the platform on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by Indian law:

• Dingit does not guarantee uninterrupted, error-free, or virus-free operation of the website or apps.
• We are not responsible for the quality, taste, hygiene, or preparation standards of food items prepared by independent third-party merchant kitchens, although we enforce strict onboarding criteria.
• In no event shall Dingit's total aggregate liability exceed the total amount paid by you for the specific disputed transaction giving rise to the claim.

Governing Law & Dispute Resolution

These Terms shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India. In the event of any legal dispute or controversy arising under these Terms, the courts situated at Noida / New Delhi, India shall have exclusive jurisdiction over all matters.
